REGULATIONS OF THE MARKETEDGE.CO WEBSITE
§1 GENERAL PROVISIONS
- These Terms and Conditions define the terms and conditions of use of the SOPI.PL website and the provision of electronic services by SOPI.PL (hereinafter referred to as the “Website”).
- The Service Provider is SOPI SP. Z O.O., with its registered office in Białystok, at 27 Łącznikowa Street, 15-163 Białystok, NIP: 9662206604, REGON: 541792835 (hereinafter referred to as the “Service Provider”).
- The Service Provider can be contacted via email at kontakt@sopi.pl.
- The Terms and Conditions are available free of charge on the SOPI.PL website, allowing for their access, reproduction, and recording at any time.
§2 DEFINITIONS
Service Provider – SOPI SP. Z O.O., owner of the SOPI.PL website.
Service – the SOPI.PL website, enabling the use of the services offered.
User – a natural person, legal entity, or organizational unit using the Website.
Account – an individual user profile on the Website enabling, among other things, order management, access to reports, and communication with the Service Provider.
Services – activities provided by the Service Provider to the User, including SEO services.
Payment Gateway – a tool enabling online payments for services on the Website.
§3 RULES OF USE OF THE SERVICE
- Use of the Website requires acceptance of the Terms and Conditions.
- The User agrees to use the Website in a manner consistent with the law and good practice.
- Minimum technical requirements:
a. Internet access,
b. Web browser with JavaScript and cookies enabled,
c. Active email address. - The following are prohibited:
a. Activities that violate the law or the rights of third parties,
b. Sharing one’s Account with third parties.
§4 SERVICES PROVIDED ON THE WEBSITE
- The Service Provider provides SEO services, including:
a. Keyword and competition analysis,
b. Content and page speed optimization,
c. Building internal and external linking,
d. Creating reports,
e. Creating dedicated content. - Services are provided based on individual orders placed by the User.
- Services begin upon payment by the User.
- The Service Provider is not responsible for the lack of SEO results resulting from factors beyond their control (e.g., changes in search engine algorithms).
§5 USER ACCOUNT
Creating an Account is necessary to use certain features of the Website, including order management.
The User agrees to:
a. Provide accurate and up-to-date information upon registration,
b. Protect Account access data.
The User has the right to delete their Account by contacting the Service Provider.If the User violates the Terms and Conditions, the Service Provider may block or delete the Account.
§6 PACKAGES AND SCOPE OF ACTIVITIES
- The services provided by the Service Provider are available in packages defining the scope of SEO activities, such as keyword analysis, website optimization, link building, and others, as described on the SOPI.PL website.
- The User selects the package when placing the order. Detailed information about the content and prices of individual packages is available on the Website or in the information materials provided by the Service Provider.
- The Service Provider only performs activities within the scope of the selected package. Expanding activities beyond the scope of the package requires separate consent from the User and agreement on additional costs.
- Changing the package during the term of the contract is possible with the consent of both parties and takes effect at the beginning of the next billing period.
- The Service Provider reserves the right to refuse to perform selected activities if they cannot be performed due to technical reasons, of which the User will be informed immediately.
- The User acknowledges that the effectiveness of SEO activities depends on many factors, including compliance with the optimization recommendations provided by the Service Provider.
§7 PAYMENTS
- Available payment methods:
a. Payments for services on the Website can be made via bank transfer to the Service Provider’s designated account.
b. Alternatively, the User can make payments via the PayNow payment gateway available on the Website. PayNow enables fast and secure online transactions, offering a variety of payment methods, such as card payments (Visa, MasterCard), fast bank transfers, BLIK, and other forms of electronic payments. The controller of personal data processed in connection with payment processing is PayNow Spółka Akcyjna, with its registered office in Gdańsk at ul. Grunwaldzka 472, 80-309 Gdańsk, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under KRS number 0000454515, Tax Identification Number (NIP) 5833165114, with the share capital of PLN 5,000,000.00, fully paid up. Contact details of the Administrator: PayNow S.A., ul. Grunwaldzka 472, 80-309 Gdańsk, Poland, email: ado@paynow.pl. All transactions are processed in accordance with the highest security standards, guaranteeing the protection of User data. - Payment process:
a. After placing an order for a service on the Website, the User receives an order confirmation along with information about the amount due.
b. When using the PayNow payment gateway, payment is immediate, and the User is redirected to the payment provider’s website to complete the transaction. - Invoices:
a. The Service Provider issues invoices for ordered services using the information provided by the User during registration or order placement.
b. The invoice will be sent electronically to the email address provided by the User. - Payment deadline:
a. Payment for ordered services should be made by the deadline specified in the order confirmation, unless otherwise agreed.
b. Failure to pay by the specified deadline may result in the order being canceled or the provision of services being suspended. Payment - Security:
a. All payments processed through the Pay Now payment gateway are handled by trusted operators, in accordance with the highest security standards.
b. The Service Provider does not store payment card details or other sensitive payment information. - Suspension of Services:
a. The Service Provider reserves the right to suspend the provision of services in the event of non-timely payment.
b. Services may be resumed after the User settles the outstanding balance. - Refunds and Adjustments:
a. In the event of a justified complaint or withdrawal from the contract, any refunds will be processed within 14 business days of the claim being accepted.
b. Refunds will be made using the same payment method used.
§8 COMPLAINTS
- Complaints regarding the services provided can be submitted in writing to the Service Provider’s registered office address or by email: kontakt@sopi.pl.
- Complaints will be reviewed within 14 business days of receipt.
§9 USER RIGHTS AND OBLIGATIONS
- The User agrees to cooperate with the Service Provider to ensure the proper implementation of the services.
- The User is obligated to inform the Service Provider of any technical changes to their website that may affect the implementation of SEO services.
- The User is obligated to follow the Service Provider’s instructions regarding website optimization.
- In the event of a lack of cooperation from the User, including failure to provide required data or failure to perform actions, the Service Provider reserves the right to suspend the provision of services until the obstacles are removed, but is not obligated to refund any fees paid.
- The User is responsible for all actions taken under their Account.
§10 WITHDRAWAL FROM THE CONTRACT
- A User who is a Consumer has the right to withdraw from the contract within 14 days of its conclusion, subject to point 2.
- The right to withdraw expires upon commencement of the provision of services with the User’s consent.
- To withdraw from the contract, please send an appropriate declaration to the Service Provider’s email address.
§11 FINAL PROVISIONS
- The Terms and Conditions are available in Polish.
- Any changes to the Terms and Conditions will be communicated to Users 14 days in advance.
- In matters not covered by the Terms and Conditions, the provisions of the Civil Code shall apply.
- All disputes will be resolved by the court having jurisdiction over the Service Provider’s registered office.
